Step 1: Report Your Injury
In order for you to take advantage of your rights, Missouri work comp laws require that you report your injury to your employer within 30 days. (There are some exceptions.)
You will have the opportunity to see a doctor. However, the doctor will be chosen for you by your employer.
Step 2: File Your Claim
In most cases, you have up to two years (sometimes three or more) to file a claim to seek the benefits allowed under Missouri work comp laws.
Additionally, you may want to seek benefits allowed under:

- Medicare and Medicaid

- State Unemployment Programs
Step 3: Attend Your Workers' Compensation Hearing
Workers' compensation hearings take place at various locations throughout Missouri.
Hearings can address a wide range of issues, including:
- Lost Wages/Temporary Total Disability (TTD)
- Settlements/Permanent Partial or Total Disability (PPD and PTD)
- Medical Care
- Vocational Rehabilitation
Missouri work comp laws also allow hearings for people who have already been through the process, but need to restart benefits that have been cut off, request additional medical care or address other issues.
These are formal hearings in front of administrative law judges. For this reason, you will benefit from the services of an experienced attorney. The employer and insurer always have an attorney.
Step 4: Appeal the Decision
If benefits were denied, or insufficient benefits were granted, Missouri work comp law gives you 30 days to appeal the decision to the Missouri Labor and Industrial Relations Commission.
